DELTA AIR LINES’ EXTRANET - TERMS OF USE
These terms of use specifically apply to Delta Air Lines' Extranet and all
access granted through this method. By using Delta's extranet, you signify your
agreement to the terms, conditions and notices of this document. Violating any
of these terms grants Delta the authority to take action to restrict or
terminate your access to the Delta Extranet. You must use the Delta Extranet in
accordance with these terms of use and all applicable federal, state and local
laws, ordinances and regulations.
TERMS OF USE - UPDATES
We reserve the right, at our sole discretion, to update or revise these terms
of use, any other policy or statement on any Delta Extranet site, and any
product offerings or programs described on any Delta Extranet site. Please refer
back periodically to the Delta Extranet to review any changes to these terms of
use.
CONTENT
All content of this extranet site is owned or controlled by Delta Air Lines
and is protected by worldwide copyright laws. You may download content only for
your business requirements while engaging Delta through this extranet. No
further reproduction or modification of the content is permitted. You must not
copy, reproduce or forward any content from this extranet site outside of Delta
Air Lines, including posting on any personal or public Web pages, blogs, or
social media sites, including, but not limited to Flyertalk, Facebook, or
Twitter. The products, technology or processes described in this site may be the
subject of other intellectual property rights reserved by Delta Air Lines or
other third parties. No license is granted with respect to those intellectual
property rights.
DELTA DOES NOT ASSUME ANY LIABILITY FOR THE COMPLETENESS, ACCURACY OR
USEFULNESS OF ANY INFORMATION DISCLOSED OR MATERIALS ACCESSED. IN NO EVENT WILL
DELTA (OR ANY RELATED PERSONS OR ENTITIES) BE LIABLE FOR ANY SPECIAL, INDIRECT
OR CONSEQUENTIAL DAMAGES ASSOCIATED WITH OR ARISING FROM USE OF THIS SERVICE IN
ANY WAY, INCLUDING ANY LOSS OF USE, DATA OR PROFITS, REGARDLESS OF THE FORM OF
ACTION.
THIS EXTRANET SITE MAY PROVIDE LINKS OR REFERENCE TO OTHER SITES, BUT DELTA
HAS NO RESPONSIBILITY FOR THE CONTENT OF SUCH OTHER SITES AND SHALL NOT BE
LIABLE FOR ANY DAMAGES OR INJURY OF ANY KIND WHATSOEVER ARISING FROM THAT
CONTENT. ANY LINKS TO OTHER SITES ARE PROVIDED MERELY AS A CONVENIENCE TO THE
USERS OF THIS EXTRANET SITE.
Additionally, you may not, by use of the Delta Extranet or any Delta service,
upload, post or otherwise distribute or facilitate distribution of any content,
including text, communications, software, images, sounds, data, or other
information that:
- Is housed on DeltaNet, obtained via Delta email, or otherwise
distributed by Delta;
- Is unlawful, threatening, abusive, harassing, libelous, defamatory,
obscene, deceptive, fraudulent, and/of invasive of another's privacy,
pornographic or inaccurate;
- Victimizes, harasses, degrades, or intimidates an individual or group
of individuals on the basis of religion, gender, sexual orientation, race,
ethnicity, age, disability or any other reason;
- Is posted in violation of a newsgroup charter;
- Contains viruses, corrupted files, or any other similar software or
programs that may damage the operation of another's computer;
- Constitutes unsolicited duplicative e-mail (commercial or otherwise);
- This prohibition extends to the sending of unsolicited mass e-mailings
from another service which in any way implicates the use of Delta or the
Delta Extranet, or any Delta e-mail address.
- A communication may be unsolicited if: (1) recipients' email addresses
were not obtained through a personal or customer relationship between
recipient and sender, (2) recipients did not affirmatively consent to
receive communications from sender, or (3) recipients have opted out of
receiving communications from sender when given notice of the opportunity
to do so.
PARTICIPATION AND COMMUNICATIONS
Delta reserves the right to monitor content and communication on the Delta
Extranet and to remove any content in Delta’s sole discretion, including content
that Delta determines to be harmful, offensive, or otherwise in violation of
these terms of use.
Any communications you send to this extranet site or otherwise to Delta Air
Lines by electronic mail, are on a non-confidential basis, and Delta Air Lines
is under no obligation to refrain from reproducing, publishing or otherwise
using them in any way for any purpose. Delta Air Lines shall own all right title
and interest, including the copyright, in, and be free to use, the content of
any such communications, including any ideas, inventions, concepts, techniques
or know-how disclosed therein, for any and all purposes, including the
developing, manufacturing and/or marketing of goods or services. Use of any
personally identifiable information will be governed by Delta Air Lines Privacy Policy.
DELTA DISCLAIMS, TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL WARRANTIES,
REPRESENTATIONS AND OTHER ENDORSEMENTS, EXPRESS OR IMPLIED, WITH REGARD TO THE
INFORMATION ACCESSED FROM, OR THROUGH, THIS SERVICE, THE SYSTEMS WHICH PROVIDE
IT AND THE INTERNET, INCLUDING ALL WARRANTIES OF MERCHANTABILITY OR FITNESS FOR
A PARTICULAR USE, OR NON-INFRINGEMENT OF ANY THIRD-PARTY RIGHTS.
The following rules have been established to protect the Delta Extranet
against abuse.
Use of the Delta Extranet for any purpose that is unlawful or in any manner
which could damage, disable, overburden or impair the operation of the Delta
Extranet or any other party's use or enjoyment of Delta's Web sites is strictly
prohibited. Specifically, you may not:
- Attempt to use or gain unauthorized access to data, accounts, hosts,
systems or networks of Delta, or to probe, scan or test the vulnerability
of a system or network of Delta, any Delta Web site or those of any other
party;
- Interfere with service to any user, host or network including, without
limitation, mail-bombing, flooding, and attempting to deliberately
overload the system;
- Forge any TCP-IP packet header or any part of the header information
in an e-mail or a newsgroup posting;
- Falsify address information or otherwise modify e-mail headers to
conceal the sender's or the recipient's identity;
- Use Delta to engage in activities that violate any terms or conditions
of any other network access provider or Internet service provider.
COPYRIGHTS, TRADEMARKS, LOGOS, AND PROPRIETARY RIGHTS
Except as expressly authorized by Delta, you agree not to use the Delta
Extranet in any manner that would infringe, violate, dilute or misappropriate
any such rights, with respect to any material, which you access or receive
through the Delta Extranet.
You acknowledge and agree that copyrights, trademarks, service marks,
patents, trade secrets, and other proprietary rights and laws protect all
content and materials available on the Delta Extranet. Nothing on the Delta
Extranet shall be interpreted or implied in such a way as to confer any license
or right to any intellectual property rights or license to any intellectual
property, content, technology, system, process, or related material belonging to
Delta by virtue of it being displayed or made accessible on the Delta Extranet.
The Delta name and logo, the Delta Extranet name and logo, other related
names, design marks, product names, feature names and related logos are
trademarks of Delta Air Lines, Inc. and may only be used with the express prior
written permission of Delta. Delta claims copyright interests in all original
content and works provided by Delta on the Delta Extranet. If any pages,
information or content is copied, it may be copied only for non-commercial uses,
strictly in accordance with these terms of use, and Delta, in any event, retains
all copyright and other proprietary interests therein.
